Calgon Carbon Expects UV Product Sales to Continue to Grow
PITTSBURGH, PA October 8, 1999 Calgon Carbon Corporation
today announced that the Federal Court of Canada denied a preliminary
injunction filed by Trojan Technologies Inc. which sought to enjoin
Calgon Carbon Corporation and Calgon Carbon Canada from making, using
or selling its Aurora UV system in Canada. The Court stated that "it
was not persuaded that the plaintiff (Trojan) has met the burden of
establishing it will suffer irreparable harm."
In response to Trojan's request for summary judgment for infringement
of its Canadian patent, the Court did not find infringement of the
Canadian patent claims by the Aurora UV System as a whole. The Court
stated that it agreed with Calgon Carbon's position "that there is no
agreement among the experts with respect to the proper construction or
interpretation" of certain phrases which were essential to a finding
of infringement by the Aurora UV System. Only one component of the
Aurora UV System was found to infringe the Trojan patent and this
decision is being appealed.
Calgon Carbon Corporation stated that the Canadian court decision has
no effect on its ability to sell, manufacture, or deliver the Aurora
UV System to its U.S. customers. The Company additionally noted that
it believes that the Canadian court decision confirms its antitrust
suit against Trojan Technologies in the United States and Calgon
Carbon intends to vigorously pursue such action.
